A dramatic turn of events has taken place in the arson fire at the former Forest City Police station. Thaddeus Ellenbecker was convicted and sentenced to serve 20 years in prison in December of 2012 for setting fire to the Forest City Police Station and stealing a gun from another officer.
The Iowa Court of Appeals has reversed Ellenbecker’s conviction by ruling that he deserves a new trial. The reason the decision was reversed according to the court documents was because that while he was in custody and being treated at the hospital, the Department of Criminal Investigation allegedly failed to read Ellenbacker his Miranda rights. The court stated in their opinion that the anything he may have said while in custody not admissible in the case.
No new trial date has been set yet.
