Seats Juvenile Sentence Upheld

   A judge has ruled that the governor’s commutation order will modify the life sentence given a Mason City man convicted of murder when he was a juvenile.

     Judge Colleen Weiland on Tuesday upheld the life sentence handed down to Damion Seats, who is now 22. But the judge said the sentence will be modified by Gov. Terry Branstad’s July 26, 2012, blanket commutation order of 60-year sentences for juveniles sentenced to life without parole.

     Seats was convicted of murdering 28-year-old Isidoro Erreguin, who was shot and killed while he slept in a Mason City home. Seats was 17 on the day of the crime in 2008.

     Seats’ attorney said Tuesday that the judge’s ruling will be appealed.
